Section 3. Secretariat of the Council. The Motor Vehicles Division of the BOI is hereby upgraded to a Department to be called Motor Vehicle Industry Department to be headed by a full time Director, which Department shall serve as the fulltime secretariat of the Council. The organizational structure, including duties and responsibilities of the Department shall be drawn and approved by the BOI Board.

 

The salary of the Director and all its personnel shall be in accordance with the provision of appropriate regulations in force.

 

Section 4. Power to Require Assistance. The Council may require, if necessary, the assistance and cooperation of any government agency or any entity or association within the industry in order to ensure the effective implementation of the powers and functions of the Council.

 

Section 5. Meetings, Quorum and Secretariat. The Council shall be organized within thirty (30) days from the promulgation of this Executive Order. The Council shall meet at least once in every quarter or as the need arises. The presence of six (6) members shall constitute a quorum for the doing of business.

 

Section 6. Honoraria and Allowances. The Council may in its discretion provide for honoraria and allowances for Council members and its personnel subject to existing rules and regulations.

 

Section 7. Appropriations. To carry out the provisions of this Executive Order, the BOI, shall submit the supplemental budget to the Department of Budget and Management, which shall set aside the initial amount of Twenty Million Pesos (P 20 million) for its organizational and augment current operational expenses from any fund in the National Treasury not otherwise appropriated. Thereafter, a regular line item in the General Appropriations Act under the BOI budget shall be provided to cover the operational requirements of the Council.

ARTICLE 2. New Motor Vehicle Development Program (NMVDP)

 

Section 1. Coverage

 

1.1 The Program shall cover the manufacture and assembly of the following motor vehicles.

 

1.1.1 Classification I -Passenger Cars
Passenger cars shall refer to any four (4)-wheel motor vehicle, which is propelled by gasoline, diesel, electricity or any other motive power and principally designed to transport persons and not primarily to transport goods.

 

1.1.2 Classification II - Commercial Vehicles
Commercial Vehicles - shall refer to any four (4) or more wheeled motor vehicle, which is propelled by gasoline, diesel, electricity and any other motive power and principally designed to transport persons and/or goods/cargoes, such as light commercial vehicles, buses, trucks, and special purposes vehicles (for example. Ambulances, fire trucks, and the like).

Light Commercial Vehicles - shall refer to vehicles whether 4-wheel drive or not, which may be classified under but not limited to the following: utility vehicles, sports utility vehicles, Asian utility vehicles and the Philippine Utility Vehicle, commuter vans, pick-ups, which are designed to carry both passenger and goods/cargoes, with GVW rating not to exceed 3.0 tons.

 

1.1.3 Classification III - Motorcycles
Motorcycles shall refer to any two or three-wheel vehicle propelled by gasoline, electricity or any other motive power, with or without sidecars.

 

1.2 The production of motor vehicles covered under the NMVDP shall be in knocked-down (KID) condition only. The KID scheme shall promote high value adding in automotive manufacturing and high degree of vehicle production operations.

 

1.3 Only brand-new Original Equipment Manufacture (OEM) KID parts and components for assembly purposes shall be eligible for importation under the NMVDP subject to such limitations as may be imposed by the BOI.
